RESOLUTION 2021-014

 

A RESOLUTION OF THE COUNCIL OF THE VILLAGE OF JEROMESVILLE ESTABLISHING THE AMERICAN RESCUE PLAN ACT FUND AND AUTHORIZING THE DEPOSIT OF FUNDS INTO SUCH ACCOUNT

WHEREAS, the American Rescue Plan Act of 2021 was signed into law by the President of the United States on March 11, 2021; and

WHEREAS, the American Rescue Plan Act of 2021 will provide additional relief to address the continued impact of COVID-19 on the economy, public health, state and local governments, individuals, and businesses; and

WHEREAS, as part of the American Rescue Plan Act, the Village of Jeromesville was provided $57,508.34; and

WHEREAS, pursuant to guidance issued by the Auditor of State in an updated bulletin dated July 2, 2021, the Federal Funding Accountability and Transparency Act (FFATA) requires separate accountability for the direct recipients (and subrecipients) of federal awards greater than $30,000; and

WHEREAS, Ohio Revised Code 5705.09 requires aubdivisions to establish separate funds for each class of revenue derived from a source other than the general property tax; and

WHEREAS, Ohio Revised Code 5705.12 further requires the taxing authority of a subdivision to establish, with the approval of the Auditor of State, a separate fund for money derived from specified sources other than the general property tax; and

WHEREAS, the Auditor of State approves taxing authorities to establish separate funds required for separate accountability of federal programs upon adoption of a local ordinance or resolution, further, local governments do not need to seek Auditor of State approval for establishing new COVID-19 federal programs.

 

Now, therefore, be it RESOLVED by the Council of the Village of Jeromesville that - 

 

  1. There is hereby and herein created a fund to be known as the “American Rescue Plan Act Fund,” with the assigned fund code of 2151. The source of monies deposited into said fund shall be the federal funds provided from the American Rescue Plan Act. Expenditures made from this fund shall comply with the broad definition of allowable uses contained within the American Rescue Plan Act. 
  2. The Director of Budget & Management is hereby directed to establish said fund and to deposit monies therein as indicated by Council. 
  3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meeting of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including requirements of Section 121.22 of the Ohio Revised Code. 
  4. This resolution is hereby declared to be an emergency measure immediately necessary for the preservation of health, safety, and welfare of the residents of the Village of Jeromesville, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approved by the Mayor or otherwise at the earliest time allowed by law.
