A RESOLUTION AFFIRMING THE MAYOR’S ROLE IN LAW ENFORCEMENT
Adopted in Regular Session (6-0)
WHEREAS, § 31.016 of the Jeromesville Municipal Code states that "He or she (the Mayor) shall see that all ordinances, bylaws, and resolutions of the Legislative Authority are faithfully obeyed and enforced"; and
WHEREAS, the Village of Jeromesville, having no municipal police department, must rely on law enforcement agents from the Ashland County Sheriff's Department; and
WHEREAS, the Village Council would like to clarify the role of the Mayor in the law enforcement process.
Now, therefore, be it RESOLVED by the Council of the Village of Jeromesville that—
- We hereby affirm that while the Mayor is the Chief Conservator of the Peace, he is not a law enforcement officer and shall not be called on, except in cases of riots, mobs and other events that would necessitate the invocation of the powers conferred upon him by § 33.02 of the Jeromesville Municipal Code, to act as such or carry out the duties of a law enforcement officer in the case of civil or criminal dispute.
- We hereby affirm that injured parties, whether in matters civil or criminal, except in cases of riots, mobs and other events that would necessitate the invocation of the powers conferred by § 33.02 of the Jeromesville Municipal Code, shall call upon law enforcement agents from the Ashland County Sheriff's Department for remedy. If the injured party feels that adequate remedy has not been given by those law enforcement agents or that a miscarriage of justice has occurred, they shall submit in writing an appeal to the Mayor to carry out his duty to "see that all ordinances, bylaws, and resolutions of the Legislative Authority are faithfully obeyed and enforced."
- The Mayor shall report to the Village Council a summary of the appeals he receives each month as well as any executive action taken in each case.
- The Mayor shall confer with the Village Solicitor upon receipt of any such appeal to determine whether the appeal is actionable after which a summary response shall be delivered to the petitioner within fourteen days of initial receipt describing whether any action may be taken or not and why.
- The Mayor shall have at his disposal the necessary resources to establish and maintain this process.
