AN ORDINANCE OF THE COUNCIL OF THE VILLAGE OF JEROMESVILLE REGULATING ANY NEW CONSTRUCTION THAT MAY IMPEDE ACCESS TO THE SHUT-OFF VALVE OR MAINTENANCE VALVE OF A UTILITY LINE

 

Adopted in Regular Session (5-0) 18 May 2021

WHEREAS, the Legislative Authority witnessed the effects of impeding access to the emergency shut off of public utilities in the event of a disaster; and 

WHEREAS, to protect the health, safety and general welfare of the residents of the Village of Jeromesville, the Legislative Authority has considered the issue and determined that certain parameters should be established for prevention of further and future impediment; and 

WHEREAS, the Legislative Authority deems it prudent to regulate the execution of new construction in right-of-ways or easements dedicated to the Village; 

 

Now, therefore, be it ORDAINED by the Council of the Village of Jeromesville that—

 

(1) there shall not be any new or expanded structures built that conceal or impede the shut off valve for any existing public utility on a Village-owned easement;

 

  1. This includes but is not limited to residential or commercial dwellings, decks, patios, porches, sidewalks and sheds.

 

(2) any person, firm, or corporation violating the provisions of this Ordinance shall be guilty of a misdemeanor subject to a fine of one hundred dollars ($100). Each and every day during which such violation continues shall be considered as a separate and distinct violation hereof and may be charged and prosecuted as such. The above specified penalties may be imposed for each such violation.
